By accessing or using AmtekPro, you agree to be bound by these Terms of Service and all terms incorporated by reference. If you do not agree to these terms, you may not use AmtekPro.
In order to access and use certain features of AmtekPro, you will be required to create an account. You must provide accurate and complete information when creating your account, and you must keep your account information up-to-date going forward. You are solely responsible for all activities that occur under your account.
You are responsible for maintaining the confidentiality of your password and for restricting access to your account. Sharing your AmtekPro account password with anyone else is strictly prohibited. Amtek Information Services, Inc. takes the security of its users' accounts very seriously, and any unauthorized access to a user's account is a violation of these Terms of Service. If you share your password, your account will be permanently banned from using AmtekPro. Always ensure that your password remains confidential and secure to protect your account.
You agree not to engage in any of the following prohibited activities: (i) copying, distributing, or disclosing any part of AmtekPro in any medium (including without limitation by any automated or non-automated "scraping"); (ii) using any automated system, including without limitation "robots," "spiders," "offline readers," etc.; (iii) transmitting spam, chain letters, or other unsolicited email; (iv) attempting to interfere with or compromise the system integrity or security, or decipher any transmissions to or from the servers running AmtekPro; (v) taking any action that imposes, or may impose, an unreasonable or disproportionately large load on our infrastructure, at our sole discretion; (vi) uploading invalid data, viruses, worms, or other software agents through AmtekPro; (vii) collecting or harvesting any personally identifiable information, including without limitation account names, from AmtekPro; (viii) impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, or hiding or attempting to hide your identity; (ix) interfering with the proper working of AmtekPro.
By accepting these Terms of Service, you agree not to infringe upon any intellectual property owned by Amtek Information Services, Inc. or any third party.
AmtekPro and its content are protected by copyright, trademark, and other such laws of both the United States and foreign countries. Except as expressly provided in these Terms of Service, nothing in these Terms of Service gives you a right to use the AmtekPro name or any of the AmtekPro trademarks, logos, domain names, and other distinctive brand features.
By accepting these Terms of Service, you agree to indemnify and hold harmless Amtek Information Services, Inc. from any claims, damages, or liabilities that may arise from your use of AmtekPro, to the maximum extent permitted by law. Furthermore, under no circumstances shall Amtek Information Services, Inc. be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of or inability to use AmtekPro, including but not limited to reliance by a user on any information obtained from AmtekPro. This includes, without limitation, mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission, or any failure of performance. The limitation of liability applies whether the claims are based on contract, tort (including negligence), strict liability, or any other legal theory, even if Amtek Information Services, Inc. has been advised of the possibility of such damages.
By accepting these Terms of Service, you consent to the exclusive jurisdiction of the state and federal courts located within Texas. This provision establishes a clear legal framework for addressing any potential issues and ensures fair and consistent dispute resolution.
AmtekPro and its content are provided "as is" and on an "as available" basis without any representations or warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Amtek Information Services, Inc. does not warrant that the service will be uninterrupted, timely, secure, error-free, or free from viruses or other harmful components. Further, the company makes no representations as to the operation of AmtekPro or the information, content, materials, or products included on AmtekPro. You agree that your use of AmtekPro is at your own risk.
Each AmtekPro account is limited to a maximum of three users. Each user must have a unique account. Each user is allowed to access and use AmtekPro on up to two devices at the same time. If you require more users or device access, this can be arranged on a case-by-case basis by contacting Amtek Information Services, Inc. directly. It is the user's responsibility to ensure that the number of users and devices in use under their account complies with these Terms of Service. Any unauthorized use of additional users or devices may result in the termination of your account.
Neither party shall be liable to the other for any delay or failure in performance under these Terms of Service arising out of a cause beyond its control and without its fault or negligence. Such causes may include but are not limited to natural disasters, wars, terrorist acts, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, or strikes.
These Terms of Service constitute the entire agreement between you and Amtek Information Services, Inc. concerning the use of AmtekPro. If any provision of these Terms of Service is deemed invalid or unenforceable by a court of competent jurisdiction, such provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.
Amtek Information Services, Inc. reserves the right to modify or discontinue, temporarily or permanently, AmtekPro or any service to which it connects, with or without notice and without liability to you. This includes changes to the features, user interfaces, and any content available through AmtekPro. We will endeavor to provide notice of any significant changes where possible, but it is the user's responsibility to regularly check AmtekPro for any updates.
Termination by Amtek Information Services, Inc.: We reserve the right, in our sole discretion, to terminate or suspend your access to AmtekPro, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users of AmtekPro, us, or third parties, or for any other reason.
Termination by User: Users may terminate their accounts at any time by contacting our support team. Termination will be effective immediately, but please note that any obligations, liabilities, or rights incurred or granted prior to termination will survive the termination of this agreement.
Amtek Information Services, Inc. does not offer refunds for any unused portion of a month, considering our subscription service's month-to-month nature. Subscribers are encouraged to fully utilize the service throughout their paid month. We prioritize customer satisfaction and aim to deliver exceptional service during every subscription cycle.
By accepting these Terms of Service, both you and Amtek Information Services, Inc. agree to resolve any dispute by individual arbitration. This means that neither party shall start or proceed upon any class action lawsuit, class-wide arbitration, or any other representative action or proceeding.
Should a dispute arise concerning the terms, breach of terms, or use of AmtekPro, the party raising the dispute shall notify the other immediately, and both parties shall make a good faith effort to resolve the issue informally. If the dispute cannot be resolved informally, both parties agree to settle the dispute through binding individual arbitration.
This agreement to arbitrate disputes includes all claims arising out of or relating to any aspect of these Terms, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of whether a claim arises during or after the termination of these Terms.
Any breach of these Terms of Service, including unauthorized use of AmtekPro, may result in immediate termination of a user's account, legal action against the offending user, and/or other remedies as available under the law. Amtek Information Services, Inc. reserves the right to take any and all action it deems necessary to protect its rights and the rights of its users.
AmtekPro may feature links to third-party websites or services not owned or overseen by Amtek Information Services, Inc. We do not endorse or assume responsibility for the content, privacy policies, or practices of these third-party websites or services. You acknowledge and agree that Amtek Information Services, Inc. is not liable, directly or indirectly, for any damage or loss resulting from your use or reliance on content, products, or services available through these third-party sites.
AmtekPro operates on a month-to-month subscription basis. Subscribers are not bound by long-term contracts and can cancel their subscriptions in line with the conditions below.
Users may cancel their account at any time by contacting our support team. To avoid being charged for the next month, ensure you cancel your subscription at least 10 days before the end of the current month. This window provides ample time for processing and prevents subscription rollover to the next month. Neglecting to cancel within this period may lead to automatic renewal for the subsequent month.
We are committed to providing the best possible experience for our users. As part of our ongoing efforts to improve our services, we may update our Terms of Service. We encourage all users to periodically review the terms to stay informed about any changes or updates.
